HEARTLESS HERTS POLICE

It took 6 Herts police officers to visit a protesting primary school parent and then cart a lady off to the cells.

So what does the obese £84,000 a year, ex-local cllr, Mr Ash-Edwards have to say about ‘his’ officers antics? Ash-Edwards is the Herts Police and Crime Commissioner. What are his qualifications? None apart from being a fairly useless local councillor

What has he done about this mess? Not very much. He claims he is having words with Chief Constable! Bit late for that Mr Ash-Edwards. ‘Your’ Force has been made to look ludicrous.

Ash-Edwards’s salary is just the thin end of it. His office employs over 35 people so his budget is well over £1 million annually.

Too many pies…a waddling PCC

If the government was serious about making savings Police and Crime commissioners should be binned immediately. All it does it provide an income stream for unemployable ex-councillors like this waste of space.

    This school and its governing body which left parents feeling frustrated whilst pursuing a complaint is a carbon copy of the former Kensington and Chelsea Tenant Management Organisation.

    Parents who would not roll over and wait for an ongoing issue to be resolved by a cumbersome complaints’ procedure are reported to the police. These unfortunate parents, who only want the best for their daughter, then decided to develop their grievance with ongoing emails to the school and with social media publicity. It may not be the nice middle class way to proceed but it is not a crime to act in this way. These parents were banned from entering the school building and its playground even when dropping their daughter off at school. They are subject to wrath of the school, its governing body, and are reported to the police for harassment and malicious communication. The former TMO was similarly high-handed. The TMO apparently sent solicitors’ letters to members of the Grenfell Action Group threatening legal action. The TMO singled out people who were difficult. The TMO and RBKC Councillors came seriously unstuck when Theresa May announced to parliament, days after the fire, that the TMO was not fit for purpose and was being disbanded.

    I do not know what Hertfordshire police thought they were doing arresting a couple in Borehamwood and driving them about twenty five miles to a custody suite at Stevenage police station; very heavy handed with around 11 hours of detention. Freedom of Speech is under attack and how dare anyone say anything outside the confines of the school’s ever so genteel complaints’ procedure. This couple have not been charged and the police are taking the matter no further.

    When will these amateur Boards of tenants/ leaseholders and now school governors realise that they have to find a way of dealing with people with whom they disagree; or have difficulties. These authoritarian Board Members are full of their own importance and are unduly influenced by managers with vested interests in the organisations in which they volunteer to serve. These school governors, like the former TMO Resident Board Members, resort to the best defence of “attack” and “gaslighting” those who do not roll over.

    The school in Borehamwood has come unstuck. The TMO and Councillors came unstuck too.

    I understand that these parents were “disobliging” about a new deputy headmistress at the school by saying, “they did not think much of the new deputy headmistress.”

    Greater Manchester Police had a complaint from a local councillor about social media posts. Greater Manchester Police have said that one is allowed to be “disobliging” on social media about councillors.

    The person who heads the governing body of this school should resign for lacking in sound judgement and proportionate decision making.

      This School’s Governing Body were well aware that these parents had a problem with the School. It is easy for these School Governors to be in high dudgeon – they believe that the School is marvellous because they have a great relationship with the School’s Management Team and its teachers. There are no unresolved issues affecting their children- how could anything possibly be wrong with their School?

      Will the Chairman of the School’s Governors, along with its management team, accept responsibility for this mess and apologise to the parents concerned and make sure that a situation like this never recurs. I doubt it.

      We have all seen how entrenched positions became with the powerful members of the Post Office Board who knew that oppressive prosecutions were being pursued against Sub-Postmasters but no one had the decency to say “Stop, let’s do the right thing.” They were content to go on seeing innocent people being punished with some being sent to prison.

      Is there room for one decent person on any of these Boards and Governing Bodies to puts self interest aside and to do the right thing instead of being righteous in perpetuating an oppressive situations. Power corrupts.

    So these parents sent an excessive number of emails to the school. The school labelled this “harassment” and reported it to the police. There’s no law prohibiting anyone from sending too many emails. These parents were frustrated at the situation in which they found themselves. The school raised the temperature of the interactions with these parents and banned them from entering the school buildings and plaground.

    The police should have known that no offence had been committed and told the school as much when the school complained. These teachers are used to controlling little children and they became distressed when they found that they could not control adults in the same way so they called in the coppers. Teachers with seriously controlling behaviour are no better than playground bullies.

    The school took exception to the parents saying on social media that they “did not think much” of the new Deputy Head. There is no law against saying that. I think this school was very sensitive and people who are sensitive become depressed and do rash things like reporting people to the police. As if the police do not have enough to do.

    These parents were not being impolite, they were expressing a sincerely held view about one of the school’s employees. There is no law against that.

    I told the TMO that it was thoroughly bad and suffered the excesses of the TMO.

    I am very concerned about the unpleasant comments made about me. The insinuation I only criticised Mr Prophet, my chief constable, after reading all the negative media comment is debatable. I am incredibly popular with my force and they don’t begrudge me my £80k a year. Some people want to get rid of all PCC’s in the UK. I am dead against this idea as I have no other income source.
    I am minded to send a team of 10 officers to get this Dame woman into the cells.
    I am now off for a vast Sunday roast with several points of ale

      I have always been opposed to the creation of Police and Crime Commissioners. It makes the police political, that is, far more political than they ever used to be.

      The old police authorities were made up of Councillors and Magistrates serving in the county in which the police force operated. These members of the police authority fixed budgets, programmed repairs to police stations and other premises owned by the constabulary and made sure that adequate resources were available to fight crime.

      In those days, operational responsibilities and decisions on local policing were the province of the Chief Constable. However, these Magistrates and local Councillors were well placed to discuss with the Chief Constable and other senior police officers issues of concern to their local communities. Magistrates gleaned this information from sitting on the local bench and councillors similarly found out what concerned people by listening to their constituents.

      What is all this “strategic” nonsense that the Police and Crime Commissioners spout.

    I am not satisfied that the Police Officers who arrested this couple have acted lawfully. Section 24 of the Police and Criminal Evidence Act 1984 provides,

    “If a constable has reasonable grounds for suspecting that an offence has been committed, he may arrest without a warrant anyone whom he has reasonable grounds to suspect of being guilty of it.”

    It is clear that the complaint made by this school in this instance fell short of providing sufficient evidence to make out the offences of Malicious Communication or Harassment.

    A competent Police Officer should have been able to distill this from reading the emails which the school would have produced to substantiate the complaint they were making. Sending a large number of emails is not in itself harassment.

    Furthermore, the mother of the child when interviewed by the police asked,

    “What is the legal definition of Malicious Communication”

    and the Officer had to look at his mobile phone to provide an answer.

    A Police Officer cannot be ordered by his superiors to go out and arrest someone. He has to be personally satisfied that he “has reasonable grounds for suspecting that an offence has been committed.”

    I think with the evidence provided by the School, no police officer could have reasonably determined that any offence had been committed. It seems a bit much to arrest a couple and to keep them in custody for eleven hours when the Officer questioning them did not know the legal definition of Malicious Communication.

    These parents irritated the school with they way that the proceeded and someone decided to show them who was boss and this has gone belly up.

    These parents would do well to seek legal advice with counsel’s opinion to see if they have a claim against Hertfordshire Police.

    Shocking. This has all the hallmarks of a “police state.”

    It would have been different if the police had visited this couple to discuss the matter and, after determining exactly what was being said in all of the emails, decided not to arrest the couple in dispute with the school. If the police had taken this sensible course of action, the parents would have been made aware of the impact that their correspondence was having on the snowflake teachers and governors at the school and may well have curtailed the number of emails they sent.

    It would have also been different if the police had asked this couple to accompany them to the police station. That would have been no more than an invitation to go with the Officers to the police station to discuss the matter and would have fallen short of an arrest with 11 hours of detention.

    The police have got egg egg their faces- no crime was committed.

    Does Hertfordshire Police (and other Police Services) bother to arrest all shoplifters nowadays?

    Shoplifting is theft and is a crime that affects everyone because those who do not steal from shops pay higher prices to cover this dishonest behaviour.

    The police say that they do not have the time to arrest shoplifters but they have the time to go mob handed to arrest this couple, in front of all their neighbours, for sending too many emails.

    The Police need to reboot and take stock.

    These parents had a confidence problem with the school’s complaints’ procedure. The school did not want this couple going public with their concerns about the recruitment and appointment of a new employee.

    Hertfordshire Police had the effrontery to tell a County Councillor that she would be liable to arrest if she continued to help or represent this couple with the school.

    I hope I don’t get arrested for writing this.

    OFSTED needs to inspect Cowley Hill Primary School to establish if it is interacting with ALL parents in a purposeful manner.

    OFSTED needs to look at the school’s strategy for interacting with parents who do not meet teachers’ expectations in respect of “disciplined” genteel behaviour.

    (Are Cowley Hill’s middle class teachers expecting all parents regardless of background to behave in a way which meets the teachers’ values.

    OFSTED needs to investigate why the school got it so wrong.

    Dear Dame,

    I am concerned.

    If the police told me that my emails constituted “malicious communication” or “harassment,” I would believe them.

    The police know what the law is – or do they?

    To believe the police in these circumstances would have been most unwise but I do trust the police and would admit to committing an offence that might never have been committed

    As I cannot afford to have a Solicitor attend on me in the police station or afford to have one to represent me in court, I would accept what the police officer said. If charged and prosecuted, I would take what was coming in court and that might mean being sent to prison even if no offence had been committed.

    Hertfordshire’s new Chief Constable, Andy Prophet, visited a number of police stations in the run up to his appointment being confirmed. He said how impressed he was the calibre of Hertfordshire’s police officers. These police officers were excessive in the way proceeded.

    Chief Constable Prophet understands the politics of being a copper and a good bloke at the same time. “Bigging up” the troops in the Hertfordshire Police Force won’t do the new boy from the Essex Force any harm. However, he is less than prophetic.
